Same-sex divorce will involve the basic issues of any divorce, including asset division and spousal maintenance. However, there may be problems resolving these issues if the couple had a previous domestic partnership. With our extensive Washington family law experience, we can help you address these issues.
Child custody can be problematic for gay and lesbian couples with children. Unless there has been a legal adoption, one spouse may not be the child’s legal parent. We will work to protect your rights and your relationship with your children in these circumstances.
You do not have to have a domestic partnership to get married, but you must note it on the marriage application if you do. Registered domestic partnerships will automatically convert to marriage licenses in June 2014 even if you do not request it. If you have a domestic partnership and are separating from your partner, we can help you divide assets and work through custody.
Washington does not have common law marriage, but if partners live together and act married, they may be considered to be in a meretricious relationship. In these cases, asset division is possible, but not alimony.
